(Family Division; Baron J; 29 June 2010)

The husband's failure to pay a lump sum and to pay arrears of child periodical payments and school fees was in contempt of an ancillary relief consent order.

At the enforcement hearing the husband initially argued that the order was not a consent order. This was manifestly untrue. The enforcement was under the Debtors Act.

The husband was committed to prison for 2 years for contempt, suspended on terms of payment.
