The Threat to Care Proceedings

David Jockelson, Solicitor, Miles and Partners. The government is proposing a fundamental and radical review of the whole system of child protection and care proceedings in England and Wales. The suggestions amount to a proposal to transfer power in child care cases, from the formal, regulated, scrutinised, painstaking and expensive process of the court, to the informal, independent, flexible, autonomous and cheap process of decisions and actions made mainly by social workers and local authorities. The author considers the proposals including the possible increased use of voluntary accommodation, a system whereby parents are persuaded by social workers to place children into voluntary care.
