The Government’s recent proposal to remove the presumption in favour of parental involvement aims to address overriding the impact of domestic abuse by setting a new starting point requiring a parent to prove that their involvement will further their child[ren]’s welfare. Will a requirement to prove, rather than a presumption unless demonstrated otherwise, go far enough to address the ongoing failings in the family justice system?
