The field of special educational needs, relevant to millions of children, generates considerable conflict. Rights, duties and discretion interact with resource allocation and policy issues. Since 1994 over 250 appeals via the direct appeal route have been made to the High Court. This article evaluates the courts' approach in resolving many difficult questions.
