Shutting the door on negligence liability: Lawrence v Pembrokeshire County Council and L v Reading Borough Council [2009] CFLQ 384

Date:26 SEP 2011

In D v East Berkshire Community Health NHS Trust the House of Lords held that healthcare and local authorities owed no duty of care in negligence to parents who were being investigated in cases of suspected child abuse. In Lawrence v Pembrokeshire County Council and L v Reading Borough Council attempts to distinguish or circumvent the D decision failed, leaving serious doubts as to whether there is now much scope left to develop this area of law in the future.
