This article considers the scope and application of s 98 Children Act in public and private children proceedings in the context of recent case-law dealing with police disclosure and the emerging transparency reforms. It considers practical pitfalls and practice points for practitioners advising parties particularly those where there are or are may be connected criminal proceedings.
