Rule 9.5: Further Reflections

Judge Clifford Bellamy In Reflections on Family Proceedings Rule 9.5 [2003] Fam Law 265, the author and his former colleague, District Judge Lord, considered the use being made of r 9.5 of the Family Proceedings Rules 1991 (SI 1991/1247) by judges in Leeds. Their investigation was undertaken against a backdrop of concern in some quarters that judges in Leeds were over-using r 9.5. Judge Bellamy now sits in the West Midlands. In one of his new courts, Coventry, he has repeated the investigation carried out in Leeds. In this article, the author considers the use of r 9.5 in light of developments during the last 3 years and by reference to a comparison of the results of the Leeds and Coventry investigations.
