Reciprocal enforcement of maintenance orders: how does it work in England and Wales?

In an article for Family Law Journal, Lisette Dupré provides a practitioner-focused analysis of the key legal frameworks that govern the recognition and enforcement, establishment and variation of international maintenance orders in England and Wales.

She provides an overview of how such orders are dealt with on a practical level by the Central Authority in England and Wales (REMO) and the specialist court (MEBC) as well as the challenges faced by practitioners and judgment creditors (aka parents) seeking such orders.

The article also discusses the recent judgment of MM v FF (Maintenance: Scope of EU Withdrawal Agreement) [2026] EWFC 1 in which the court clarified the scope of the application of the EU Maintenance Regulation to international maintenance proceedings initiated before the end of the Brexit transition period. This case also highlighted the complexity of such cases and the difficulties faced by applicants.
