LEAVE TO REMOVE: Re D (Leave to Remove: Shared Residence)

The judge granted the mother's application for leave to remove the children to the USA notwithstanding that the children, aged 10, 11 and 14, had been dividing their time between the parents equally under a mediated shared care arrangement. There was no reason why a joint residence order should not be made spanning more than one jurisdiction. The children would be spending significant amounts of time in the UK and in the USA, and a shared residence order was the appropriate order.
