Abduction – Return order – Art 13(b), Hague Convention – Finding that father had been violent towards the children – Return order granted – Application claiming breach of Arts 3 and 8 of the European Convention
The European Court of Human Rights found that the Art 8 rights of the mother and children had been breached by the Romanian courts ordering a return of the children to Italy notwithstanding that it had been found that the father had been violent towards them.
