The interest of this article is that it brings together two topics of importance to family lawyers - mediation as an alternative to Court proceedings and the need for practitioners to recognise and respond to issues of neurodivergence in the family justice system. Having established that the prevalence of neurodivergent clients in family proceedings is higher than many might appreciate, the authors think deeply about how mediators assess suitability for mediation. They demystify what for some is the daunting landscape of neurodivergence, by explaining what neurodivergence is and what it isn’t. The article provides practical, and often simple, steps as to how to assess and work with neurodivergent clients in the context of mediation to help ensure that mediation is as accessible as possible.
