 In F & Anor v Nottinghamshire County Council & Ors [2026] EWHC 931 (Fam), McKendrick J has provided an interesting analysis of the issues where foster carers apply for an injunction to prevent children placed with them from being removed. Noting the important ‘constitutional issues’ arising in applications of this type, McKendrick J has outlined a procedural route that many practitioners in this area may hitherto have discounted. This article will consider the at times apparently conflicting case law in this area, before going through the analysis of McKenrick J and then suggesting how practitioners may need to approach these types of injunction in the future.
