The authors examine the Jersey courts approach to enforcement of the orders made in the recent High Court case, Minwalla v Minwalla and others [2004] EWHC 2823 (Fam),[2005] 1 FLR 771. The Royal Court of Jersey had to consider the extent to which the declaration that a Jersey trust was a sham, together with the other consequential orders made, should be recognised and enforced as a matter of comity.
