Miller takes case to Strasbourg

According to The Daily Telegraph of 3 June 2007, Mr Miller (Miller v Miller; McFarlane v McFarlane [2006] 1 FLR 1186, HL) has lodged an appeal with the European Court of Human Rights. He is apparently claiming that the level of discretion available to the courts has meant the law has become so confused and unpredictable that the award out to his former wife breached his human rights, specifically his right to property. His chances of success were not rated highly in the New Law Journal of 8 June.
