Mendoza v Ghaidan - Two steps forward, one step back [2003] CFLQ 313

The Court of Appeal ruled that a same-sex partner was entitled to succeed to a statutory tenancy in the name of his deceased partner under paragraph 2(2) of Schedule 1 to the Rent Act 1977 as if he were the husband or wife of the deceased. This comment discusses the courts' approach to section 3 of the Human Rights Act 1998 and the implications for further recognition of same-sex relationships.
