Siddique Patel, has published in the International Family Law Journal regarding a recently reported case involving child arrangements relating to a 3-year-old child where the father was resident in the UAE and the child resident in the UK.

After a contested final hearing, with the mother opposed to any form of foreign contact, the English court allowed the father being allowed to have unsupervised contact in the UK, increasing to overnight stays and finally, in 2026, being allowed to take the child to the UAE for a week each year after.

This gave rise to the unique issue in the case which satisfied the public interest need for the case to be reported.  In his judgment, the learned Judge gave direction that the terms of the agreement were to be presented to the UAE court and must be particularised in an agreed annex to the final order made in the English proceedings.
