It is widely assumed that where the care of a child is divided equally between its parents there will be no liability for child support. However in practice matters can turn out differently and parents sometimes find themselves involved in lengthy disputes with the Child Maintenance Service. Jody Atkinson explains the law and how the CMS have applied the law as well as the relevant Upper Tribunal decisions.
