The Law Society has published the evidence it submitted to the Joint Committee on Human Rights' (JCHR) pre-legislative scrutiny of the Divorce, Dissolution and Separation Bill, which received Royal Assent on 25 June 2020.
"In June 2020, we submitted written evidence to the Joint Committee on Human Rights’ (JCHR) pre-legislative scrutiny of the Divorce, Dissolution and Separation Bill.
While highlighting our support to remove fault from the divorce process, this submission identifies the potential challenges under the Human Rights Act.
We strongly recommended that the government review the Bill and ensure respondents were provided with sufficient notice to seek independent legal and financial advice in order to understand their position and reach the best decisions for themselves and any children involved in the relationship."
