Lasting Powers of Attorney

A consultation paper on lasting powers of attorney (LPA) forms and guidance was published in January 2006. Under the Mental Capacity Act 2005, LPAs will replace enduring powers of attorney as the main way of choosing a decision-maker to act in the event of loss of mental capacity. The Act is due to come into force in April 2007. The consultation paper is available on the Department of Constitutional Affairs (DCA) website at http://www.dca.gov.uk/consult/powerattorney/cp0106.htm and responses are required by 14 April 2006. Further information about the Mental Capacity Act is also available on the DCA website at http://www.dca.gov.uk/capacity/index.htm.
