GUIDANCE/DIVISION OF ASSETS: K v K (Financial Relief: Management of Difficult Cases) [2005] EWHC 1070 (Fam)

The hope that clearer guidance as to division of assets could help to minimise litigation is shown to be navely optimistic in relation to cases where, as in this case, the parties have the assets and the mindset to use the courts as simply another weapon against each other. Baron J stated that that rigorous case management, aided by judicial continuity and suitable expertise, was the way to control the spiralling costs and the litigation stress that were such a feature in this case.
