Two barristers with expertise in immigration law and how it intersects with family law provide a practical guide for how to handle cases which raise immigration issues. The article covers: the guiding principles; how to gather information about a client/party’s immigration position; what to be mindful of when disclosing information about a client’s involvement in family proceedings; how family law orders are treated by the Home Office; and the immigration position of a client/party who has ongoing family proceedings. The article also highlights the importance of resolving any immigration matters of children in the care of local authorities as swiftly and comprehensively as possible. The article concludes by encouraging collaborative working between immigration and family practitioners.
