The issue of compliance with the duty to provide full and frank disclosure of financial and other circumstances in ancillary relief cases is often a thorny one for practitioners. Pursuing proper disclosure can be lengthy and expensive because parties often do not want to give it. One recurring situation is where one party knows or suspects the other has an interest in land but which is being denied or ignored. If they have insufficient or no details of the property they cannot access Office Copy Entries of the title from HM Land Registry.
