MON 01/03/2010 - The Family Procedure Rule Committee has published details of its work between May and December 2009.
May, June and July 2009 The committee met in May, June and July to continue its consideration of responses to the consultation paper
Family Procedure Rules - an invitation to comment on the Draft Rules, Practice Directions and Forms.
It also considered:
- proposed amendments to the Family Proceedings Rules 1991 to support the implementation of certain provisions of the Human Fertilisation and Embryology Act 2008;
- whether to prescribe the procedure for appeals against deduction orders made by the Child Maintenance Enforcement Commission under the Child Support Act 1991 to amend the form of application for a Forced Marriage Protection Order, and;
- whether to make consequential changes arising out of the Childcare Act 2006 and the Children and Young Persons Act 2008.
Members of the Family Proceedings Rule Committee made the
Family Proceedings (Amendment) (No.3) Rules 2009, S.I. 2009 No.2027 (L.22) on 21 July 2009.
October, November and December 2009 The committee met in October, November and December to continue its consideration of responses to the consultation paper on the Draft Rules, Practice Directions and Forms.
The committee's Experts Working Party met to consider responses to the committee's consultation in relation to Part 24 (Experts and Assessors) of the draft Family Procedure Rules. The committee's Costs Working Party agreed to consider responses to the committee's consultation in relation to Part 27 (Costs).
Additionally, the committee considered proposed amendments to the Family Proceedings Rules 1991 to support the implementation of provisions relating to:
i. parental orders under the Human Fertilisation and Embryology Act 2008;
ii. orders preventing avoidance under the Child Support Act 1991, as amended by the Child Maintenance and Other Payments Act 2008.
The committee was also informed of proposals relating to media reporting of family proceedings which might lead to rules, subject to any changes to primary legislation.
