This article argues for the introduction of a statutory definition of honour-based abuse to better support victims and guide legal professionals. Currently, victims of honour-based abuse are prevented from accessing consistent protection due to professionals not understanding what honour-based abuse is. This will often lead to victims being further exposed to honour-based abuse, even after seeking protection.
In this article, the challenges faced by professionals handling such cases will be examined. Particular focus will be given to the difficulties encountered by family lawyers in presenting these cases, and by judges in incorporating honour-based abuse into welfare assessments.
Karma Nirvana, a leading charity supporting victims of honour-based abuse, have proposed a statutory definition within their ‘Push for Change’ campaign, which seeks for a definition to be introduced. This article will evaluate their proposal and its potential for legislative adoption, by considering how a statutory definition would enhance the ability of the family courts to effectively respond to cases involving honour-based abuse.
