Disclosure in Care Proceedings: Managing the Unmanageable

The article is adapted from a lecture given in Summer 2005 as part of a memorial evening in honour of David Hershman QC and Alan Levy QC. The event was hosted by the Association of Lawyers for Children. The article attempts an overview of the law relating to disclosure of social services documents in care proceedings and highlights some of the practical issues that arise. Some of the article is based on the writer's experience of local practice and whilst some authorities may adhere to protocols or policies which ensure transparency and fairness at all stages of the process, most would acknowledge room for improvement in this developing and difficult area.
