Delay - what Lord Bingham of Cornhill, in a slightly different context, calls the 'pernicious evil' of 'the ill consequences of delay' (Attorney General's Reference No 2 of 2001 [2003] UKHL 68, [2004] 2 WLR 1, at para [16]) - raises two different issues in child support litigation: delay in dealing with enforcement action by the Secretary of State, now the Child Maintenance and Enforcement Commission (the Commission) and questions of limitation of enforcement action arising from Limitation Act 1980.
