Sophie Mitchell, Media law barrister, St Pauls Chambers
In this article, Baljinder Bath, family law barrister at 4PB, and Sophie Mitchell, media law barrister at St Paul's Chambers, discuss the range of UK legal frameworks that are engaged in relation to AI deepfake porn and non-consensual sexual deepfakes.
The article is written in light of mounting global concern around social media, AI and digital harms, particularly towards women and children. From ‘report-remove’ websites and revenge porn helplines, to use of inherent jurisdiction and specific civil injunctive reliefs, the authors explore the different legal and practical remedies that family lawyers can use with reference to legislation and case law across family, crime and civil law.
Setting out the growth capabilities of AI and the extent of online violence against women and girls in recent years, Baljinder and Sophie call for family lawyers to work collaboratively and pro-actively with lawyers in other practice areas to support individuals who are victims of technology-facilitated sexual violence.
