This article sets out key cases and principles addressing the common issues which arise when representing clients in Children Act proceedings concerned with the effect their contact and financial arrangements will have on child maintenance. Contains guidance to assist with advising clients in Children Act proceeding as to orders are made varying contact, targeted issues covered includes: shared care, overnights, and third party childcare. This article also contains guidance on unaccounted for income streams, diversions of income, and the relevance of contact costs and mortgage contributions by the non-resident parent.
