CAFCASS: In Court Conciliation and Out of Court Mediation

The two approaches that have emerged most strongly from new CAFCASS schemes to date can be described as the 'rational' versus the 'therapeutic'. This article makes the case for the therapeutic approach to dispute resolution being developed alongside the rational approach and within an increased use of mediation. It is argued that the former approach is the model that is best suited to the most enduring and worrying cases. It is, however, the approach that is least well established or recognised at the present time. See May [2006] Fam Law 389 for the full article.
