Artificial intelligence and the Family Courts: understanding risk, responsibility, and the changing landscape of justice

In this article for the Family Law Journal Baljinder Bath barrister at specialist family law set 4PB and Bianca Farthing of AI Edify discuss the complex questions raised by the increased use of artificial intelligence in the Family Courts.

They simplify how AI tools work and explain how the problem is not the AI tools themselves but the way in which humans interact with them.

They highlight the work of Matthew Lee’s work in identifying the eight different types of hallucinated cases that regularly appear before the Courts. They go on to discuss the now three reported cases about AI in the Family Courts all of which involved litigants in person.

Overall they argue that AI offers distinct benefits but also significant challenges to the family justice system requiring AI tools to be used with great care such that the integrity of the Rule of Law is maintained.
