Collaborative nuptial agreements: plain sailing - well almost

Mediation collaborative law and now family law arbitration.  The alternative dispute resolution movement has gained considerable momentum in family law in recent years.  Practitioners now have a plethora of dispute resolution process options to offer clients who in turn are looking for creative and cost effective solutions to ever complex private matters. 

This article considers changes in the legal services field especially increasing demand for nuptial agreements and the Law Commission consultation which found significant support for 'qualifying nuptial agreements'.  The authors highlight how the collaborative law model is uniquely well suited to the negotiation of ante and post nuptial agreements and identify the practical benefits for both clients and practitioners of the 'collaborative nuptial agreement'.
