David Hodson on International Family Law: Update on EU divorce enhanced cooperation regulation

David HodsonIn my opinion piece dated 5 December EU justice ministers approve European divorce enhanced cooperation I referred to the intended new regulation dealing with applicable law on divorce of 14 member states. I said that it was expected to go before the EU parliament later in December. More details are now available.

It is "Council Regulation (EU) 1259/2010 of the 20 December 2010 implementing enhanced cooperation in the area of the law applicable to divorce and legal separation".  It was passed by the EU Council on 20 December 2010.  

It entered into force the day after publication in the official Journal of the European Union which was dated 29 December and therefore into force on 30 of December 2010. 

Apart from Article 17 which relates to reporting requirements on member states it shall apply from 21 June 2012.
