The English mother and Swedish father had two children aged 4 and 2 and lived in Sweden. The mother relocated with the children to England but claimed the father had consented/acquiesced due to an agreement they made before the children were born. Written agreement stating the father granted permission for the mother to leave Sweden with the children temporarily or permanently for any reason. The mother had never been happy living in Sweden, suffered from depression and anxiety.
Refused return order. Terms of agreement clear and unequivocal, father had at all times consented to the children's removal and had on several occasions reaffirmed his consent.
