Honour Judge Jonathan Butler sits at Chester Civil and Family Justice Centre and is Nominated Judge of the Court of Protection.
He is author for Mental Health Tribunals: Law and Practice as well as General Editor for Community Care Law and Local Authority Handbook.
As a barrister he has been instructed in cases involving such matters as the unlawful removal of an adult from his home; deprivation of liberty of adults and children lacking capacity; displacement of nearest relatives; judicial review of decisions regarding accommodation of adults and older children; unlawful charging for local authority services; inherent jurisdiction for vulnerable adults; the role of Guardianship vs Court of Protection; damages for breach of the European Convention of Human Rights; emergency applications regarding life sustaining treatment; welfare decisions involving capacity to enter into sexual relationships; property and affairs decisions.
He has practiced in community care law and mental health law for nearly 20 years, and in the Court of Protection since it started in 2007.
He is also regularly requested to provide training to professionals including social workers, solicitors, and the judiciary. He represents and advises on all aspects of community care law. He has particular experience of provisions for older children with mental disorders, and sits as a specialist Tribunal Judge where children have been detained under the Mental Health Act 1983.
