Law Commission Report due

Law CommissionThe Law Commission's report on matrimonial property, needs and agreements, is due to be published 27 February 2013.

The Law Commission commenced a project in October 2009 to examine the status and enforceability of marital property agreements. The initial consultation paper, reviewing the current law of marital property agreements, discussing options for reform and putting forward questions for consultees, was published 11 January 2011 with consultation closing on 11 April 2011.

In the autumn of 2011 it was agreed that the project should be extended and that a supplementary consultation encompassing two further aspects of financial provision on divorce/dissolution, namely the law relating to financial needs and the law relating to non-matrimonial property, should be carried out.

In an article for March Family Law, Professor Elizabeth Cooke, Law Commissioner for England and Wales, will reveal the contents of the forthcoming report which together with a draft Bill, an Executive Summary, an Impact Assessment and responses to both consultations will also be available on the Law Commission website.
