Following an allegation by the child that he had been abused by a resident of the borough in which the mother lived, the CAFCASS officer recommended that the child should not be required to have contact with the mother in her borough of residence. Nonetheless, the judge ordered the father to take the child to the mother's borough of residence for contact with the mother.

The judge had failed sufficiently to reflect the need to protect the child from the risk of harm. The mother was to have contact in a neutral safe location.
