Applications for Non-Molestation Orders are at the highest level since records began. Apparently fuelled by the impact of an increase in domestic violence incidents during the course of the Covid-19 pandemic, this article re-visits Non-Molestation Orders. What are they and how do you get one? This article reviews the relevant legislation and case law, considers when it is appropriate to apply without notice and reflects on the criminalisation of Non-Molestation Orders and how they compare with Restraining Orders imposed by the criminal court.
