Surrogacy – Husband seeking to use one remaining embryo with surrogate after sudden death of wife – No written consent from wife – Consent had been given in event of husband’s death – Husband arguing no sufficient opportunity for wife to give written consent
The Family Court allowed the applicant’s application, who sought a declaration that it was lawful for him to use an embryo created using his sperm and the eggs of his late wife in treatment with a surrogate.
