(Family Division; Baron J; 20 July 2005) 1 FLR 62
In a case where 10 adult members of the husband's extended family lived in the matrimonial home, the court held that neither the husband nor the extended family had established a beneficial interest in the second property for any other member. The husband was the sole legal and beneficial owner. An assessment of the wife's needs was based on the familys cultural background. The husband had made an extra contribution as his father had started a business and this had resulted in the acquisition of family fortunes. This justified moving away from the equality principle.
