(Family Division, Holman J, 4 June 2015)
[The judicially approved judgment and accompanying headnote has now published in Family Law Reports 1 FLR 1186
Please see attached file below for full judgment. The wife was awarded a lump sum of £1.2m plus periodical payments of £320,000 pa for her own benefit and £25,000 pa per child.
The husband and wife were in a relationship for 9 years and had two children together. Following their separation the children remained with the wife and had contact with the husband. It was agreed that the wife's application for financial remedy would be assessed on a needs basis and that to meet her housing needs she would need to receive a greater share of the assets than the husband.
So far the parties had spent £1m in legal costs which amounted to approximately 25% of the total liquid capital. They had attempted two in-court settlements but had been unsuccessful.
During the marriage the husband transferred to the wife a 1% shareholding in a company which currently yielded approximately $180,000 pa. The shares were now held in a trust for the benefit of the two children.
