The aim of this article is to provide practitioners with a practical guide on how to approach family businesses within financial remedy proceedings and what can be achieved with the aid of expert evidence.

In addition, the article analyses the leading authorities to reveal how the court approaches valuation evidence and the sharing of family businesses, including accounting for non-matrimonial contributions.

Finally, the article provides an overview of the powers available to protect parties under the Companies Act 2006, in particular the duties of directors and protections against unfair prejudice
