(Family Division, Judd J DBE, 28 January 2022)
Family proceedings – Reporting restrictions order – Child’s parents charged with murder of sibling - Local authority applying for reporting restrictions order to protect identity of child - Application opposed by several media organisations.
The court held, balancing competing rights under art 8 and 10 of the ECHR, that the application to prohibit reporting of the names of either of the parents or of the deceased in the criminal proceedings had to be refused.
