(Court of Appeal, Thorpe, Aikens, Black LJJ, 4 May 2012) 

The parents were married in Pakistan and had a child. When the parents separated the mother claimed the father had been physically and emotionally abusive towards her.

In contact proceedings the judge accepted the mother's evidence that the father had threatened to abduct the child and had made threats of violence against the mother's extended family and so made no order for contact between the father and child. The father appealed.

Since the hearing the father had made no attempt to engage with therapeutic services offered to him and the judge had been within the exercise of his discretion to make the decision to order no contact given the findings on the father's behaviour. Appeal dismissed.
