The 81-year-old man suffered from vascular dementia, memory and cognitive impairment as well as diabetes and after being admitted to hospital in a state of neglect he was accommodated in a residential care home under Sch A1 to the Mental Capacity Act 2005.
The court provided guidance as to the principal and procedure of appointing a Relevant Person’s Representative as litigation friend.
