The mother was refused permission to bring a contact order application. At issue was whether the judge was plainly wrong. The mother was still caring for the younger brother of the adopted child. There was a real improvement in the mother's capacity.
In allowing a birth mother's appeal against the refusal of permission to apply for contact with the adopted child, the Court emphasised the Art 8 rights of the adopted child's brother.
