(Court of Appeal; Ward and Wall LJJ; 7 February 2008)
The newborn baby was returned to the mother by order of the court, having been removed unlawfully. Subsequently, an interim care order was made, and judicial authority provided for the baby's removal from the mother. The baby was placed in foster care and the mother had contact with him 5 days a week for 3 hours at a time.
The judge had been entitled to, and it had been almost inevitable that he would, make the interim care order.
