In both cases there had been a violation of Art 6.1 of the European Convention for the Protection of Human Rights and Fundamental Freedoms 1950 on account of the excessive length of proceedings: 9 years in the contact case; over 8 years in the parental responsibility case. The Czech authorities had failed to enforce contact, imposing ineffective fines on the mother in the contact case, and had failed to take adequate action against the mother for her lack of cooperation in the parental responsibility case.
