Contact order in place for 9-year-old child to have staying contact with her father when he visited the UK. Allegations by a young girl that the father had sexually abused her when she was young. Mother applied to vary contact order and sought disclosure of the allegations. Physical and mental health of the young girl had been affected by sexual abuse. Application for disclosure dismissed.
Compelling her to give evidence would be oppressive and wrong and would have a severe impact on her health. Unresolved allegation left real difficulties for the question of contact. Unsupervised contact would not automatically be ordered.
