A commercial surrogacy arrangement had been made in the USA. The arrangement was lawful under US law but unlawful under Human Fertilisation and Embryology Act 2008. Payments in excess of reasonable expenses were made. A parental order could only be made if the expenses were nonetheless authorised by court.
A Parental Order under s 54 HFEA 2008 was made as it was in children's best interests.
