This Guidance, issued by the President of the Family Division on 17 December 2010, is intended to assist judges and magistrates in determining when they should order an expert's report or additional assessments.
There are two main particular types of case management decisions in which a judge or magistrate may need to consider ordering a report. The first relates to additional reports or assessments of children and their parents in care proceedings. The second is applications under section 38(6) of the Children Act 1989. The Guidance deals with each of these in turn.
